1. Acceptance

These Terms of Use ("Terms") constitute a binding agreement between Vebilisim Teknoloji A.Ş. ("Company", "we", "us") and the user ("User", "you") of Qaza Qada: Prayer Tracker ("App").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App. This agreement is solely between you and Vebilisim Teknoloji A.Ş. Apple Inc., Google LLC, and any app store operators are not parties to this agreement.

2. Definitions

  • App: The Qaza Qada: Prayer Tracker mobile application available on iOS and Android platforms.
  • User: Any individual who downloads, installs, or uses the App.
  • Subscription: A paid, auto-renewing membership acquired through an in-app purchase that provides access to premium features for a specified duration.
  • User Content: Custom data entered by the User within the App, specifically prayer tracking logs and statistics.

3. License Scope

The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes.

Under this license, you may:

  • Use the App on compatible devices you own or control.
  • Follow the Apple App Store Usage Rules (for iOS devices) or Google Play Terms of Service (for Android devices).

Under this license, you may not:

  • Copy, modify, or create derivative works of the App.
  • Reverse engineer, decompile, or disassemble the App.
  • Transfer the license or grant sublicenses to third parties.
  • Use the App for any unlawful purpose.

4. Account and Usage

  • The App uses anonymous authentication, and no personal identifiable information is required to start using it.
  • You are responsible for the security of your device and ensuring your prayer data is managed securely.
  • You are responsible for all activities that occur on your device regarding the App.

5. Paid Features and Subscriptions

5.1 Premium Subscription Features

The App offers an annual subscription plan. Subscribing grants you access to premium features, including: ad removal, detailed historical statistics tracking, premium themes, and the ability to export qaza prayer records as PDF files. Current pricing is displayed in the respective app store prior to purchase.

5.2 Auto-Renewal

The subscription automatically renews on a yearly basis unless auto-renew is canceled at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period.

5.3 Management and Cancellation

You can manage and cancel your subscriptions through your device settings:

  • iOS: Settings > Apple ID > Subscriptions
  • Android: Google Play Store > Subscriptions > Manage

5.4 Refunds

All billing and refund requests are handled directly through the app store where the purchase was made (Apple App Store or Google Play Store). Refund policies are subject to the respective store's terms and conditions.

6. User Content

  • You may create custom content within the App (e.g., logging qaza prayers).
  • This content is associated with your installation/device and is accessible only to you unless you choose to export it.
  • You are responsible for ensuring your data usage complies with these Terms.

7. Acceptable Use

The following activities are strictly prohibited:

  • Using the App for unlawful, harmful, or rights-infringing purposes.
  • Attempting to compromise the security or integrity of the App.
  • Accessing the App through automated tools, bots, or scraping methods.
  • Actions that place an unreasonable load on the App's infrastructure.

8. Intellectual Property

All intellectual property rights related to the App and its content (including copyrights, trademarks, UI/UX designs, and algorithms) belong to Vebilisim Teknoloji A.Ş. No rights are transferred other than the limited license granted under these Terms. Responsibility for investigating and addressing intellectual property infringement claims rests solely with the Company, not Apple or Google.

9. Warranty and Limitation of Liability

Warranty: The App is provided "as is" and "as available." The Company makes no express or implied warranties that the App will be uninterrupted, error-free, or fully secure. Warranty responsibility rests solely with the Company. Apple Inc. and Google LLC have no warranty obligations with respect to the App.

Limitation of Liability: The Company is not liable for any indirect, incidental, special, or punitive damages arising from the use or inability to use the App (including data loss).

10. Maintenance and Support

Maintenance and technical support for the App are provided solely by the Company. Apple Inc. and Google LLC have no obligation whatsoever to furnish any maintenance or support services for the App.

11. Termination and Data Deletion

  • You may uninstall the App from your device at any time.
  • You can permanently delete your tracked data via the in-app settings.
  • The Company reserves the right to suspend or terminate access for users who violate these Terms.

12. Children and Age Restrictions

The App is not intended for use by children under 13. Users under 13 must use the App only under the supervision of a parent or legal guardian. The App complies with Apple's and Google's age verification and rating requirements.

As a User, you represent and warrant that:

  • You are not located in a country that is subject to a U.S. Government embargo, or that has been designated by the U.S. Government as a "terrorist supporting" country.
  • You are not listed on any U.S. Government list of prohibited or restricted parties.

14. Third-Party Beneficiaries

Apple Inc., Google LLC, and their subsidiaries are third-party beneficiaries of these Terms. Upon your acceptance of these Terms, they will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.

15. Changes to Terms

The Company reserves the right to update these Terms at any time. Significant changes will be communicated via in-app notifications or store update notes. Continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. The Courts and Enforcement Offices of İzmir shall have exclusive jurisdiction over any disputes arising from these Terms.
