1. Acceptance

These Terms of Use ("Terms") constitute a binding agreement between Vebilisim Teknoloji A.Ş. ("Company", "we", "us") and the user ("User", "you") of Zikirmatik: Dhikr & Tasbeeh ("App").

By downloading, installing, or using the App, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

This agreement is solely between you and Vebilisim Teknoloji A.Ş. Apple Inc., Google LLC, and any app store operators are not parties to this agreement.

2. Definitions

  • App: The Zikirmatik: Dhikr & Tasbeeh mobile application available on iOS and Android platforms
  • User: Any individual who downloads, installs, or uses the App
  • Subscription: A paid membership acquired through in-app purchase that provides access to premium features for a specified duration
  • Content: Text, graphics, audio, and other materials provided within the App
  • User Content: Custom content created by the User within the App

3. License

The Company grants you a limited, non-exclusive, non-transferable, and revocable license to use the App for personal, non-commercial purposes.

Under this license, you may:

  • Use the App on devices you own or control
  • On iOS devices, Apple App Store Usage Rules apply; on Android devices, Google Play Terms of Service apply

Under this license, you may not:

  • Copy, modify, or create derivative works of the App
  • Reverse engineer, decompile, or disassemble the App
  • Transfer the license or grant sublicenses to third parties
  • Use the App for any unlawful purpose

4. Account and Usage

  • The App uses anonymous authentication. No personal information is required to create an account.
  • You are responsible for the security of your device and account access.
  • You are responsible for all activities that occur under your account.

5. Paid Features and Subscriptions

5.1 Subscription Plan

The App offers a yearly subscription plan. The subscription removes in-app advertisements. Current pricing is displayed in the respective app store.

5.2 Auto-Renewal

The subscription automatically renews unless canceled at least 24 hours before the end of the current period.

5.4 Management and Cancellation

  • iOS: Settings > Apple ID > Subscriptions
  • Android: Google Play Store > Subscriptions

5.5 Refunds

Refund requests are handled through the app store where the purchase was made (Apple App Store or Google Play Store). Refund policies are subject to the respective store's terms.

6. User Content

  • You may create custom content within the App (e.g., custom dhikrs).
  • Content you create is associated with your account and accessible only to you.
  • You are responsible for ensuring your content complies with applicable laws and these Terms.
  • The Company reserves the right to remove user content that violates applicable laws or these Terms without prior notice.

7. Acceptable Use

The following activities are prohibited when using the App:

  • Using the App for unlawful, harmful, or rights-infringing purposes
  • Attempting to compromise the security of the App
  • Accessing the App through automated tools, bots, or similar methods
  • Using the App to harass, threaten, or disturb others
  • Actions that place an unreasonable load on the App's infrastructure

8. Intellectual Property

All intellectual property rights related to the App and its content (including copyrights, trademarks, and designs) belong to Vebilisim Teknoloji A.Ş. No rights are transferred other than the license granted under these Terms.

Responsibility for investigating and addressing intellectual property infringement claims rests solely with the Company.

9. Warranty and Limitation of Liability

9.1 Warranty

The App is provided "as is" and "as available." The Company makes no express or implied warranties that the App will be uninterrupted, error-free, or secure.

Warranty responsibility rests solely with the Company. Apple Inc. and Google LLC have no warranty obligations with respect to the App.

9.2 Limitation of Liability

The Company is not liable for any indirect, incidental, special, or punitive damages arising from the use or inability to use the App. The Company's total liability shall not exceed the total amount paid by the User for the App in the preceding 12 months.

10. Maintenance and Support

Maintenance and support for the App are provided solely by the Company. Apple Inc. and Google LLC have no obligation to provide any maintenance or support for the App.

11. Account Termination and Deletion

  • You may uninstall the App from your device at any time.
  • You may permanently delete your account and all associated data from the Settings section within the App.
  • The Company reserves the right to suspend or terminate accounts that violate these Terms.

12. Children and Age Restrictions

The App is not intended for use by children under 13. Users under 13 must use the App only under the supervision of a parent or legal guardian.

The App operates in compliance with Apple's and Google's age verification requirements.

As a User, you represent and warrant that:

  • You are not located in a country subject to a U.S. embargo
  • You are not listed on any U.S. Government prohibited or restricted parties list
  • You will comply with all applicable local, national, and international laws when using the App

14. Third-Party Beneficiaries

Apple Inc. and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce these Terms against you.

15. Changes

The Company reserves the right to update these Terms at any time. You will be notified of significant changes through in-app notifications. Your continued use of the App after changes constitutes acceptance of the updated Terms.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of the Republic of Turkey. The Courts and Enforcement Offices of İzmir shall have jurisdiction over any disputes arising from these Terms.
